03 · What is a cookie?
And what we don't use.

A cookie is a small piece of text a website asks your browser to keep between visits. We also use localStorage for the same purpose, for our own preferences, never for anyone else's. Throughout this notice, "cookie" covers both.

We do not use device fingerprinting, browser canvas profiling, ETags-as-tracking, or any of the substitutes that the industry has invented to evade the cookie consent regime.

04 · Your choices
Consent, change of mind, withdrawal.

4.1 When you first visit, a banner offers Accept or Decline. Strictly-necessary cookies (§ A) are set regardless because the site cannot function without them, the law explicitly exempts these from consent. Analytics cookies (§ C) load only if you accept.

4.2 Change your mind at any time: clear your browser's site data for smemarket.ch, then reload, the consent banner re-appears.

4.3 You can also clear cookies through your browser's settings, Chrome, Firefox, Safari, Edge all expose this under *Settings → Privacy*. Clearing them logs you out and resets your language / theme preferences.

05 · Third-party processors and data location
Who processes data on our behalf when you accept analytics, and where it goes.

When you accept analytics, the following processor is engaged:

Google Analytics 4 — Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, acting as our processor under the Google Ads Data Processing Terms. Configuration: IP truncation active, advertising features and Google Signals disabled, no remarketing, no audience export.

Where the data goes. Analytics data may be processed and stored on servers located in the European Economic Area. Switzerland and the EEA mutually recognise each other as providing an adequate level of data protection, and any processing in the EEA is protected under GDPR standards. Where Google transfers residual data onward to Google LLC (USA), that transfer is covered by the safeguards recognised for Swiss transfers — the Swiss–U.S. Data Privacy Framework and/or Standard Contractual Clauses as adapted for Switzerland and recognised by the FDPIC, supplemented by technical measures (IP truncation at collection, encryption in transit).

We never sell, share, or syndicate cookie or analytics data to advertising networks, data brokers, or affiliate programmes.

06 · Legal basis
TCA, nDSG, GDPR, ePrivacy.

6.1 Strictly necessary and functional cookies (§ A, § B). Set on the basis of Art. 45c lit. b of the Swiss Telecommunications Act (TCA/FMG) — information about the processing and the right to refuse via browser settings — and of our overriding legitimate interest in operating a secure, functional platform (Art. 31 para. 1 nDSG). Where the GDPR applies, the legal basis is Art. 6(1)(f) GDPR, and these cookies are exempt from consent under Art. 5(3) of the ePrivacy Directive as strictly necessary for the service requested.

6.2 Analytics cookies (§ C). Although Swiss law follows an information-and-refusal model (Art. 45c lit. b TCA), we voluntarily apply the stricter consent standard: analytics cookies are set only after your explicit opt-in. Where the GDPR applies, this consent is the legal basis under Art. 6(1)(a) GDPR in conjunction with Art. 5(3) ePrivacy Directive. You may withdraw consent at any time (§ 04).

07 · Updates to this notice
Versioning and re-consent.

We update this page whenever a new cookie is added, a duration changes, or a processor changes. The version number at the top of the document changes each time. Material changes (introduction of new categories, addition of marketing cookies) require a fresh consent request, the banner is re-armed automatically.
